Lo faces a total of 42 criminal counts following his arrest after the tragic events at the Lapu-Lapu Day festival in April 2025.
The 30-year-old has been charged with 11 counts of second-degree murder and 31 counts of attempted murder.
A provincial court judge found Lo fit to stand trial in September.
Last month, Crown prosecutor Michaela Donnelly told a court that the Crown prefers a direct indictment in Lo’s case, which requires the approval of the provincial attorney general and means there won’t be any preliminary hearings where evidence can be tested.
The case was officially transferred to the higher court on Jan. 15, and Lo’s first appearance was scheduled for Feb. 11.
Some of the victims in the attack have also filed a proposed class-action civil lawsuit in BC Supreme Court, alleging Lo had been diagnosed with schizophrenia some time before the attack and that he had asked to have his antipsychotic medication reduced, even as his mental health was deteriorating.
The lawsuit names as defendants the City of Vancouver, Vancouver Coastal Health Authority, and Lo.
The BC Prosecution Service tells CityNews that Lo is likely to appear virtually Tuesday.
Editor’s note: an earlier version of the article incorrectly listed the suspect’s scheduled court appearance time as “around 10 a.m.” Tuesday. In fact, he is expected to appear in court around 2 p.m.
